Terms of Service

You need an account to keep a collection, and you must be at least 13 years old to have one. Keep your sign-in details to yourself — anything done through your account is treated as done by you. Tell us promptly if you think someone else has access to it.

One person, one account, except for team accounts, where each seat belongs to a named person. Seats are not to be shared between people.

You keep every right you have in what you upload. Nothing here transfers ownership of your pictures, your writing, or your records to us.

To run the service we need a narrow, practical licence: permission to store your content, to make the copies and resized versions needed to display it, and to show it to the people you have chosen to show it to. That licence exists only so HOP can do what you are asking it to do, it is not exclusive, and it ends when you delete the content or the account — apart from copies that persist briefly in routine backups.

We do not use your content to train machine-learning models, and we do not use it to promote HOP without asking you first.

Do not upload anything you do not have the right to upload. Do not use HOP for material that is unlawful, that sexualises children, that exists to harass someone, or that infringes another person’s copyright or trade marks.

Do not use the service to attack it: no attempts to break authentication, reach other accounts’ private content, scrape at a scale that degrades it for others, or work around the limits of your plan.

We would rather write to you than remove things, and for anything ambiguous we will. But we may remove content or suspend an account that breaks these rules, and we will tell you why when we do.

If something on HOP infringes your copyright, write to hello@hop.gallery identifying the work, the page it appears on, and your contact details, and confirming that you hold the right or act for whoever does. We will look at it and remove anything infringing. Accounts that repeatedly infringe are closed.

Free accounts are free. Paid plans are billed in advance through Stripe, monthly or yearly as you choose, and renew automatically until cancelled. Team accounts are billed per seat, and a seat is counted once it has been accepted.

Cancel whenever you like: your plan keeps running to the end of the period you have paid for, and then stops. We do not refund part-used periods as a matter of course, but if something went wrong, write to us — we would rather sort it out than stand behind a policy.

If prices change, existing subscribers get notice before it affects them.

If a paid plan ends and your collection is larger than the free plan allows, nothing is deleted immediately. The excess is kept for thirty days, hidden rather than destroyed, so you can export it or resubscribe. After that window it may be removed.

Your register — accession numbers, content fingerprints, dates — is part of your record and is exportable on every plan.

HOP records that a particular file was registered to a particular account at a particular time, and gives you a certificate saying so. That is a real and useful fact, and it is the only fact it asserts.

It is not proof of authorship, originality, ownership, provenance or authenticity, and it is not a legal instrument. Do not present it as one. Valuations and provenance you record are your own statements, not ours.

We work to keep HOP up and fast, but it is provided as it is, without a guarantee of uninterrupted service. There will be maintenance, and occasionally there will be failures.

Keep your own copies of anything irreplaceable. HOP is built to be a good home for your pictures and to let you take them out at any time; it is not a substitute for a backup.

To the extent the law allows, HOP is provided without warranties of any kind, and we are not liable for indirect or consequential losses — including lost profits, lost business, or the cost of recreating content. Where we are liable, our total liability is limited to what you paid us in the twelve months before the claim, or one hundred US dollars, whichever is greater.

Nothing here excludes liability that cannot lawfully be excluded.

You can delete your account at any time, from Settings. Doing so removes your content — see the privacy policy for exactly what that means.

We may suspend or close an account that breaks these terms, or if we have to stop offering the service. If we ever shut HOP down, we will give reasonable notice and a window to export everything.

We may update these terms; the date at the top shows the current version, and we will give notice of changes that materially affect you. Continuing to use HOP after that means accepting them.

These terms are governed by the laws of the State of New York, and the courts of New York County have jurisdiction. Questions: hello@hop.gallery.
